“Women in Shar’ia Courts: A True History”
Abstract:
This lecture is designed to introduce new concepts related to the legal systems of the Arab world and the rights of women in Islamic civilization and Arab societies by selecting samples of cases expressive of these systems, their history, culture and politics. Also, the presence of women in courts as a party to litigation expressing themselves is revealed.
Discussion of the selected cases raises awareness of controversial issues throughout history and helps in understanding and engaging in contemporary social and legal debates, placing them within the context of Islamic legal theory. This ensures better understanding of women’s position in the legal systems applicable in the Arab and Muslim societies. Using computational methods ensures the appreciation of diverse perspectives and modes implemented by courts to secure individual and social interests, as well as the facilitation of the appreciation of different social factors that are taken into consideration by the courts.
The event is organized in cooperation with the Orient Institut Beirut (OIB) within the framework of the DAAD project “Clusters of Scientific Innovation in the Middle East and North Africa” (COSIMENA), which is a platform that aims to strengthen and initiate scientific cooperation and networks between researchers and universities in Germany and the MENA region. As a result, existing cooperation is made visible and potential synergies are initiated.
